These terms and conditions apply to purchases at www.oldenkombucha.dk

When shopping, you must read and accept the following terms and conditions to complete the purchase. The trading conditions follow EU consumer law. As a user of our website, and when making a purchase from Olden ApS, you acknowledge that you do so under these terms and conditions. We hope you will agree that they are designed to be fair to you and to us. We may update this page from time to time.

Purchase

You must ensure that the details provided by you on registration or at any time are correct and complete.  You must inform us immediately of any changes to the information that you provided when registering, by updating your personal details. You must give us your real name, address, phone number, email address and any other details that we may require to process your order.

We reserve the right to: a) decline a new customer registration or suspend a customer’s account at any time and at our sole discretion b) in our absolute discretion, to terminate your access to all or part of the services with or without notice c) in our absolute discretion, to discontinue the website or services, or any part thereof, at any time, with or without notice

You must be at least 18 years old to purchase products from our website.  If you decide to set up an account on our website, you are exclusively responsible for the supervision, management, and control of your username and password.  We reserve the right to refuse service, terminate your account, or cancel your order in our discretion, including without limitation, if we believe that your conduct violates applicable law or is harmful to our interests.

When purchasing products from our website, you will be asked to provide us with payment information including: (i) your credit card number, (ii) your name as it appears on your credit card, (iii) the credit card type, (iv) the date of expiration, and (v) the security code for the card.  You represent, warrant, and agree that you will not use any credit card or other form of payment unless you have all necessary and legally required authorization to do so.  

We will not be liable in the event your children or others acting with or without your permission use your credit card to make purchases on our website, and to the extent your minor children make any such purchases, you represent and warrant that they are authorized to do so.  In this regard, please report any unauthorized use of your payment information or your account to us, so we can help prevent future unauthorized use of your payment information or account.

Availability

Goods are subject to availability.  Our acceptance of your offer to purchase our goods is subject to their availability. Our acknowledgement of order acceptance via the web or email is not a guarantee of delivery. If we are unable to deliver the goods which you have offered to purchase, we will let you know as quickly as possible and a full refund will be given. Orders that include sale items may be sent incomplete if certain sale lines are out of stock. Your card will be refunded and you will be notified as above.

Pricing

The prices which you must pay for the products that you order are set out on the website at the time you place your order (plus a delivery charge), except where we discover an error in the price of the products you have ordered. In this event, we will inform you as soon as possible after receiving your order and give you the option of reconfirming your order at the correct price, or cancelling it. If we are unable to contact you, we will treat the order as cancelled. The prices quoted on this website apply only to products sold via this website.  Where the same products are available via another stockist different prices may apply. All prices are shown in £ sterling and include VAT where applicable (no VAT on tea).

Description and Product Information

Although we will take all reasonable care to ensure that all descriptions, details and prices of products appearing on the website are correct at the time when the information was entered onto the system, the information appearing on this website at any time may not reflect the exact position at the moment you place an order. Please be aware that the colours and appearance of our products may vary slightly from the way they appear on the screen and we cannot guarantee that your monitor screen will accurately reflect the colour of the product on delivery. All measurements and sizes are approximate, although we make every effort to ensure that they are as accurate as possible.

Right of withdrawal

Orders can be cancelled as long as freight has not been booked for the shipment. If the customer has received an email with tracking information about the shipment, the order can no longer be cancelled. Write an email with your name and booking number to ao@oldenkombucha.dk if you wish to cancel an order.

Delivery

Provided that we have processed and received payment in full for the products, ownership of an item will pass to you once we have delivered the item to you (either directly, or by leaving it in a safe place or with a neighbour). When an item has been delivered, risk of damage to, or loss of, the item passes to you.

Returns & Complains

 We hope you are happy with any product purchased, but if you wish to return a product to us for any reason you may do so within 7 days of the dispatch date. It must be in a saleable condition, unopened and in its original undamaged packaging. We will refund the price or replace the product. Return delivery charges will only be refunded in the event of faulty, damaged or incorrect items being sent to you. Other than for defective products, returns outside the timeframe set out above may be accepted at the sole discretion of Olden.

Complaints or requests for returns regarding products purchased in a physical store or from a dealer other than Olden ApS should be addressed to where the product was purchased. Complaints regarding shipping should be addressed directly to the shipping company.

We do not resell personal information and do not pass on your personal information to others, they are only registered in our customer database. You can have your information deleted at any time.

In order for you to enter into an agreement with Olden ApS, we need the following information: Name, Address, Telephone number, Email. We register your personal data with the aim of being able to deliver the goods to you. The personal information is registered with Olden ApS and stored for up to five years, after which the information is deleted. When personal data is collected via our website, we ensure that it always happens by giving your express consent, so that you are informed about exactly what information is collected and why.

As registered with Olden ApS, you always have the right to object to the registration. You also have the right to access what information is registered about you. You have these rights according to the Personal Data Act and inquiries in connection with this should be directed to ao@oldenkombucha.dk.

Payment

Website changes and update

In order to keep our website as accurate and as up to date as reasonably possible, it may be necessary, from time to time, to restrict access to the site in order to undertake necessary maintenance work. We will make every effort to ensure that any down time or restricted access is kept to a minimum.

Limitation on liability

To the extent permitted under applicable law, Olden, and its affiliates, licensors, service providers, employees, agents, officers and members shall not be liable for any indirect, special, or consequential damages, whether foreseeable or not, that are in any way related to these Terms and Conditions, products available on this website, any viruses or other harmful code affecting this website, the use or inability to use this website, loss of goodwill or profits, and/or lost business.

In any event, Olden’s aggregate liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount you paid to old kombucha in the 12 months prior to the events giving rise to your claim.

Indemnification

You agree to defend, indemnify and hold harmless Olden Kombucha, its affiliates, licensors, service providers, employees, agents, officers and members, from and against any and all claims, damages, costs and expenses (including attorneys’ fees), arising from and relating to your violation of these Terms and Conditions or your use of this website.

Governing law and Jurisdiction

Olden Kombucha maintains and operates this website from its office in Aarhus, Denmark. Any dispute or claim arising from or related to these Terms of Use or this website will be governed by and construed in accordance with the laws, without giving effect to any choice or conflict of law provision. Any legal suit, action, or proceeding arising from or related to these Terms and Conditions or our website will be instituted exclusively in the state courts located in Denmark, although we retain the right to bring any suit, action or proceeding against you for breach of these Terms and Conditions in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Waiver and Severability

Our failure to enforce any provision or right under these Terms and Conditions shall not be deemed a waiver of such provision or the right to enforce such provision.

If any provision of these Terms and Conditions is held by a court of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent necessary so that the remaining provisions of these Terms of Use will continue in full force and effect.
